From Mediation to Litigation: A Holistic Look at Divorce Options

Divorce is rarely easy. It's a time of immense change and emotional upheaval. If you're contemplating or going through a divorce in Illinois, you're likely feeling lost and overwhelmed. But here's the good news: You have options.

At Joerika Stitt Esquire, LLC, we understand the challenges you face. We're here to provide the information, guidance, and support you need to navigate this difficult time with confidence. We believe in empowering you to choose the divorce process that aligns best with your unique needs and goals.

Choosing the Right Path for Your Divorce

There's no one-size-fits-all solution when it comes to divorce. The best approach depends on your unique circumstances, your goals, and your relationship with your spouse. Let's explore the different paths available, drawing from our experience helping clients like you:

  1. Litigation: This involves the courtroom process, which can be necessary for certain situations.

    • When it might be necessary: Litigation is often the best approach in cases involving domestic violence, where protecting the safety and well-being of the abused spouse and any children is paramount. For instance, we recently represented a client who had suffered years of domestic abuse. Through litigation, we were able to secure an order of protection to ensure her safety throughout the divorce process. Litigation is also vital when one spouse is intentionally hiding assets or when complex business valuations are required. We once helped a client whose spouse had transferred marital funds into a hidden account. Litigation allowed us to uncover this information and ensure a fair division of assets.

  2. Mediation: In this process, a neutral third party helps you and your spouse communicate effectively and reach mutually agreeable solutions. Mediation is often faster, less expensive, and less adversarial than litigation.

    • When it can be a good fit: Mediation is often a successful route for couples who are willing to communicate and compromise, even if they have differing opinions on certain issues. I recently mediated a case where the couple disagreed on the division of their retirement assets. By facilitating open communication and exploring different options, we were able to reach a mutually agreeable solution.

I also recently helped a couple navigate a particularly contentious issue regarding their children's education. They had strong opposing views on where their children should attend school. Through mediation, we were able to create a parenting plan that addressed both parents' concerns and ultimately prioritized the children's best interests.

  3. Collaborative Law: Both spouses have their own attorneys, but everyone commits to resolving the divorce respectfully and constructively, often with the help of other professionals like financial specialists and child specialists. This approach fosters cooperation and minimizes conflict.

    • Ideal for complex situations: Collaborative law is particularly helpful for families with specific needs. We recently worked with a couple who had a child with special needs. By involving a child specialist in the collaborative process, we were able to create a parenting plan and child support agreement that addressed the child's unique needs and ensured their well-being.

  4. Uncontested Divorce: If you and your spouse agree on all terms of the divorce (asset division, child custody, etc.), you can pursue an uncontested divorce, which is the quickest and most efficient option.

    • A smooth and cost-effective choice: This was the perfect solution for a couple who came to us with a pre-nuptial agreement and a shared desire to keep the divorce amicable. We were able to finalize their divorce quickly and with minimal stress.
